Terms of Service

These Terms of Service ("Terms") govern access to and use of Affiliate Manager, a web application operated by Xvelox ("Xvelox," "we," "us," or "our") for affiliate marketing operations, content workflows, product review assets, and related TikTok integrations.

By accessing or using Affiliate Manager, you agree to these Terms. If you use the service on behalf of a company or organization, you represent that you are authorized to bind that organization.

Eligibility and Accounts

Affiliate Manager is intended for authorized business users who are at least 18 years old. You are responsible for maintaining accurate account information, protecting credentials, and all activity under your account. You must promptly notify us of suspected unauthorized access.

Acceptable Use

• Use the service only for lawful business purposes and in compliance with applicable platform policies.
• Do not attempt to bypass authentication, rate limits, security controls, review requirements, or access restrictions.
• Do not upload, generate, publish, or distribute unlawful, deceptive, infringing, harmful, or abusive content.
• Do not use the service to spam, manipulate engagement, misrepresent sponsorships, hide affiliate disclosures, or violate advertising, consumer protection, or influencer marketing rules.
• Do not reverse engineer, overload, scrape, probe, or interfere with the service or connected third-party platforms.

TikTok Platform Compliance

If you connect TikTok or use TikTok-related features, you must comply with all applicable TikTok terms, developer requirements, community guidelines, commerce policies, affiliate program rules, API documentation, scope limitations, rate limits, and content disclosure obligations. You are responsible for ensuring that campaigns, creator relationships, product claims, videos, captions, links, and disclosures comply with law and TikTok requirements.

We may suspend or restrict TikTok-related features if required by TikTok, law, security review, platform policy, or risk of misuse.

User Content and Permissions

You retain ownership of content, product data, campaign information, and materials you submit to Affiliate Manager. You grant Xvelox a limited license to host, process, transmit, display, and modify that content as needed to provide, secure, support, and improve the service and to perform actions you request through connected platforms.

Third-Party Services

Affiliate Manager may integrate with TikTok and other third-party services. Third-party services are governed by their own terms and policies. We are not responsible for third-party platforms, outages, policy changes, API changes, review decisions, content moderation, commissions, payouts, or account actions.

Privacy

Our Privacy Policy explains how we collect, use, share, and retain information. By using Affiliate Manager, you acknowledge the Privacy Policy.

Service Changes and Suspension

We may modify, suspend, or discontinue all or part of the service at any time. We may suspend or terminate access if we believe you violated these Terms, created legal or security risk, infringed third-party rights, or used the service in a way that may harm Xvelox, TikTok, users, or third parties.

Disclaimers

Affiliate Manager is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted or error-free operation. We do not guarantee TikTok approval, API availability, campaign performance, affiliate eligibility, commissions, payouts, sales, reach, engagement, or revenue.

Limitation of Liability

To the maximum extent permitted by law, Xvelox will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, platform account action, or third-party claims arising from or related to the service.

Indemnity

You agree to defend, indemnify, and hold harmless Xvelox from claims, losses, liabilities, damages, costs, and expenses arising from your content, campaigns, platform use, violation of these Terms, violation of law, or infringement of third-party rights.

Changes to These Terms

We may update these Terms from time to time. The effective date above identifies the latest version. Continued use of the service after changes become effective means you accept the updated Terms.
